Product Liability Insurance Supplement Manufacturer


Every supplement manufacturer should carry product liability. Here is a good example why they need the insurance. Ephedra was banned in the United states on October, 2006 for the second time because too many people were having side effects and there were even some deaths reported. Ephedra was banned for the first time in 2003 after the Food and Drug administration received evidence that over 800 people had suffered from heart attacks , strokes, and some deaths from 1994 to 2003. Some people disagreed with the FDA and filed a petition in 2004 to get the ban lifted. The court agreed with the people and stated that the FDA did not have enough evidence to prove that ephedra was dangerous enough to take it off of the market. There was not enough proof that ephedra was dangerous if used in small doses as little as 10 mg. So the ban was lifted in 2005. The FDA continued to receive reports of people having strokes and heart attacks while taking as little as 8 mg. The FDA had some of the products which contained ephedra tested. The results showed that some of the products had more ephedra than was listed on the labels of the bottles and some contained less ephedra than was listed. Some of the products tested contained no ephedra at all. There were over 1,000 reports of strokes and heart attacks and at least 17 deaths from 1997 to 2006 so the FDA took the information and reports back to court and got ephedra banned again for the second time.

Many people have filed lawsuits and received compensation for their injuries from the use of the ephedra products. Others have filed lawsuits and are waiting for their day in court. Still others are filing lawsuits everyday. If you suffered from a product which contained ephedra or if you lost a family member because of a ephedra based product, you might be eligible for compensation too. Discuss it with a good lawyer in your area who handles this type of case if your statute of limitations has not expired already.

When the supplement manufactures have product liability insurance the lawsuits will be turned over to the insurance company. The companies pay high insurance fees to handle their cases so they do not go broke trying to pay out of pocket for lawsuits. Of course if they are very careful and use natural products and clean environment to manufacture them, they should not have any problems or at least they should be minimal. Many people like to sue a company just to be greedy and they will drum up charges against a company to make money.
